Summary
This is a public warning notice issued by CIMA naming a list of registered directors who have failed to maintain their registration under the Directors Registration and Licensing Act, 2014 (as amended). CIMA states it has been unable to locate or correspond with these individuals and is therefore publishing the notice to give them and interested parties formal notice of proposed action.
- Breach identified: Failure to maintain registration by providing required information in the prescribed form and paying the prescribed annual registration fee on or before 15 January each calendar year, contrary to section 6(2) of the Act.
- Proposed action: CIMA proposes to cancel each listed director's registration under section 25(2)(a) of the Act, based on its opinion under section 25(1)(b) that the Act has been contravened.
- Fitness and propriety impact: CIMA notes that the lack of communication may be taken into account when assessing these directors' fitness and propriety in relation to existing regulated mutual funds, registrants, licensees, or future applications.
- Right to respond: Named directors may make written representations to the Authority's Chief Executive Officer within 45 days of the notice date, or a longer period if a timely extension request is approved.
