Summary

This is a CIMA notice publishing the gazetted list of "Recognized Overseas Regulatory Authorities" for purposes of section 2 of the Securities Investment Business Law (2011 Revision). The list is used under Schedule 4(5) of that Law, which allows a person to qualify for "excluded person" status (and thus fall outside certain licensing requirements for securities investment business) if they are regulated by one of the listed overseas authorities.

The document itself does not create new licensing or reporting duties; it is a reference list identifying which foreign securities/financial regulators are recognized by CIMA for this exclusion. It applies to persons or firms conducting securities investment business in or from the Cayman Islands who wish to rely on regulation by an equivalent overseas authority (e.g., the SEC, FCA, BaFin, MAS, etc.) to claim excluded person status.

Compliance officers should check this list when assessing whether a group entity's home regulator is recognized for the purposes of claiming the Schedule 4(5) exclusion under SIBL.

Applies to

persons carrying on securities investment business, persons seeking excluded person status under Schedule 4(5) of the Securities Investment Business Law
