Summary

This is a UK Order in Council extending to specified British Overseas Territories (including the BVI), made under the Sanctions and Anti-Money Laundering Act 2018 framework. It revokes a large number of earlier Orders in Council that had extended pre-Brexit EU-derived and UN sanctions regimes to the Overseas Territories. It does not itself impose new substantive sanctions requirements; it clears away superseded legal instruments as they are replaced by a new suite of sanctions Orders under the Sanctions Act.

  • Schedule 1 revocations: A long list of country and thematic sanctions orders (e.g. Belarus, Iran, Syria, Zimbabwe, Somalia, DPRK, Russia/Crimea, Venezuela, Cyber, Chemical Weapons) are revoked, taking effect immediately after six specified 2020 EU Exit sanctions amendment regulations come into force in the UK.
  • Schedule 2 revocations: A further set of orders (Tunisia, Egypt, Ukraine, Sudan, Yemen, Iraq, Turkey drilling sanctions) are revoked, taking effect on IP completion day.
  • Reason for revocation: The explanatory note confirms these older sanctions orders are superseded by new Orders in Council extending, with modifications, the UK sanctions regulations made under Part 1 of the Sanctions and Anti-Money Laundering Act 2018 to the Overseas Territories.

No impact assessment was prepared, as the UK government considered there would be no significant impact on private, voluntary or public sectors. Practically, this Order is a housekeeping measure aligning the legal basis for sanctions in the Overseas Territories with the UK's post-Brexit sanctions framework, rather than a document creating new compliance duties for firms.

Deadlines

  • immediately after specified 2020 EU Exit sanctions amendment regulations come into force in the UK: Article 2(1) and Schedule 1 revocations take effect at this time
  • IP completion day: All other articles and Schedule 2 revocations take effect on IP completion day
