International Sanctions Regulations 2013

Summary

This Bermuda regulation gives legal force in Bermuda to a list of United Kingdom Orders in Council that impose international sanctions (asset freezes, trade restrictions, terrorism and human rights sanctions regimes, etc), even where those Orders have not been separately extended to Bermuda. It also sets out how the Governor's statutory duty to publish sanctions target lists and restricted goods lists can be satisfied, and revokes a set of older, superseded sanctions regulations.

• Incorporation of UK Orders: Every Order in Council listed in Schedule 1 (covering regimes such as Russia, Syria, DPRK, Iran, terrorism, chemical weapons, and many country-specific sanctions) has the force of law in Bermuda, with territory references construed to include Bermuda.
• Publication mechanism: The Governor's obligation to maintain and publish lists of designated/listed persons and restricted goods is satisfied by publishing a web address linking to the UK's consolidated sanctions list and related EU/UK export control lists.
• Revocation: A number of older, country-specific International Sanctions Regulations (2005-2012) listed in Schedule 2 are revoked as superseded by the consolidated UK Orders in Council framework.

The regulation is primarily a legal mechanism for applying UK sanctions law in Bermuda rather than a standalone set of compliance procedures; substantive prohibitions and obligations (e.g. asset freezes, prohibited dealings) derive from the individual Orders in Council listed in Schedule 1, which are periodically updated by amending regulations.

Key obligations

• All persons and entities in Bermuda must comply with the sanctions measures imposed by each Order in Council listed in Schedule 1, as those Orders are amended from time to time.
• The Governor must publish and maintain a working web address linking to the consolidated UK sanctions list and to the consolidated list of restricted goods (UK Export Control Order Schedule 2, EU Common Military List, and relevant EU Regulation annexes).
