Summary

This is a consultation paper issued by the Jersey Data Protection Authority (JDPA), part of JOIC, proposing a revised fee model for data protection registration covering both private and public sector organisations. It sets out changes to registration fees last updated in 2020 and invites feedback before any legislative changes are made to the Data Protection (Registration and Charges) (Jersey) Regulations 2018.

  • Small business fee cuts: Proposed reductions include sole trader fees from £70 to £30, and a 50% reduction for businesses with 1-49 FTEs, plus a fee exemption for all new businesses in their first calendar year of trading.
  • Large entity fee increase: Base fee for organisations with 50+ FTEs would rise from £500 to £650, a 30% increase.

  • RPI-linked adjustment power: Proposal to allow JDPA to adjust fees annually in line with RPI within set boundaries, avoiding the need for States Assembly approval for each change.
  • Administered entities: Proposed increase in the administered entity registration fee from £50 to £64 per year, affecting trust company and fund services businesses licensed under the Financial Services (Jersey) Law 1998.
  • Public sector proposals: Consultation asks whether the current fee exemption for Public Authorities and Provided Schools should be removed, and proposes a single aggregated annual fee for Government of Jersey/Public Authorities based on affordability, fairness and risk.
  • Dissolved entities: Proposal to remove the requirement for dissolved entities to register annually until data destruction is complete.

The paper is a consultation only; none of the proposed fee changes are yet in force. Respondents are asked to answer a series of structured questions (via online survey, email or post) on the general principles, private sector proposals, administered entity proposals, and public sector proposals, with responses due by Friday 20 February 2026.
