2024 MoU with The Isle of Man Information Commissioner

Summary

This is a Memorandum of Understanding between the Jersey Data Protection Authority/Information Commissioner (JDPA/JOIC) and the Isle of Man Information Commissioner (IOMIC), setting out a non-binding framework for cooperation and information sharing between the two data protection regulators. It does not create legal obligations on either regulator, does not modify any laws, and does not impose obligations on private organisations or individuals.

• Purpose: Establishes principles for regulatory cooperation, mutual assistance and information exchange to support enforcement of data protection and freedom of information laws in each jurisdiction.
• Scope: Covers sharing best practice, joint research, cooperation on specific projects (e.g. children's privacy, AI, regulatory sandboxes), exchange of information on investigations, joint cross-border investigations, and annual bilateral meetings.
• Information sharing basis: Each regulator may share information, including personal data, with the other only where it has lawful authority to do so under its own legislation, and information is normally shared for intelligence purposes only unless a formal request is made.
• Confidentiality and handling: Sets out procedures for requesting assistance, marking and classifying shared information, notifying the other party of disclosure demands, and secure retention/disposal of shared information.
• Not legally binding: Expressly states it is a statement of intent that does not create binding obligations, does not require either regulator to cooperate or share information, and does not affect other MoUs or legal requirements.

The MoU applies only to the two regulators themselves and does not directly impose requirements on data controllers, processors or other regulated businesses in Jersey or the Isle of Man.

Deadlines

• once both Parties have signed it: MoU takes effect upon signature by both the JDPA/Information Commissioner and the IOMIC
• 30 days' advance written notice: Either party may terminate the MoU by giving this notice period to the other party
• within five business days: Oral requests for assistance made in urgent cases should be confirmed in writing within this period, unless otherwise agreed
