Summary
These Rules set out the procedure for appealing to the Royal Court against a decision of the registrar under the Registration of Business Names (Jersey) Law 1956. They govern how an appellant lodges an appeal, whether it is determined in chambers or at a hearing, and how costs are dealt with.
- Notice of appeal: An appellant must lodge a notice of appeal with the Judicial Greffier within 21 days of the date of the registrar's decision notice, using the form in the Schedule.
- Supporting documents: The notice of appeal must be accompanied by a copy of the registrar's notice, a statement of the grounds of appeal, and the appellant's case in support.
- Chambers or hearing: If the appellant does not request a hearing, the Court may determine the appeal in chambers; if a hearing is requested, the Judicial Greffier must serve notice of the time and date on the appellant and registrar at least 4 clear days before the hearing.
- Costs: Costs of the proceedings are at the Court's discretion, including who pays and how much.
The Rules apply narrowly to anyone appealing a registrar decision on business name registration under the 1956 Law, rather than imposing ongoing compliance duties on regulated financial services entities.
