Summary
This Order creates a narrow exemption from parts of the Financial Services (Jersey) Law 1998 for persons who hold an insurance business permit in Jersey. It clarifies that such permit holders do not need separate investment business authorisation under that Law when their investment activity arises from carrying on their permitted insurance business.
- Who is exempt: A person authorised to carry on insurance business in or from within Jersey under a permit granted under Article 7 of the Insurance Business (Jersey) Law 1996, when that person is carrying on investment business.
- Scope of exemption: The exemption is limited to Articles 13 to 18 (inclusive) of the Financial Services (Jersey) Law 1998, not the whole Law.
- Effect: Such insurance permit holders are not required to comply with the investment business provisions covered by Articles 13 to 18 in respect of investment business activity connected to their insurance business.
The Order has been in force since 2 February 2001 and remains current in its consolidated form. It does not impose new obligations; it defines a scope-of-application carve-out for insurance permit holders under the investment business regime.
