Summary

This Jersey Order (made under the Financial Services (Disclosure and Provision of Information) (Jersey) Law 2020) sets out the detailed categories of information that entities must actually provide to the Jersey Financial Services Commission under that Law, and creates a series of exemptions and simplified reporting routes for certain categories of entity. It covers beneficial owner information, significant person information, nominated person details, and the content of the annual confirmation statement.

  • Beneficial owner information: Name(s), correspondence address, residential address, nationality, occupation, gender, date and place of birth of each beneficial owner.
  • Significant person information: Equivalent identifying details for individuals, entities or organisations that are significant persons, plus the nominator's name where a significant person is a nominee director.
  • Nominated person information: Name, address and email (individual) or entity type, name, registered address and number (entity) of the nominated person.
  • Annual confirmation statement: Registered/business address, nominee director nominator details, and (for companies) detailed shareholder/member and share class information, or (for LLPs) solvency statement and Article 11 record-keeping confirmations.
  • Exemptions and variations: The Viscount is exempt from Articles 4 to 7 duties; state owned entities, entities wholly owned by listed parents, listed entities themselves, and entities owned by certain Jersey regulated entities may substitute simplified confirmations instead of full beneficial owner information.
  • Charity fee exemption: Charities registered under the Charities (Jersey) Law 2014 are exempt from the fee payable under Article 7(1)(b) of the Law.

The Order came into force on 6 January 2021, and Article 5(1) was subsequently amended with effect from 1 June 2026 by the Companies (Jersey) Amendment Law 2026.

Key obligations

  • Entities must provide the prescribed beneficial owner information (name, addresses, nationality, occupation, gender, date and place of birth) to the Commission under Article 4 of the Law.
  • Entities must provide the prescribed significant person information for individuals, entities and organisations that are significant persons, including nominator details for nominee directors.
  • Entities must provide the prescribed information about their nominated person under Article 4(1)(d) of the Law.
  • Entities must include the prescribed additional information in their annual confirmation statement under Article 5(1) of the Law, including registered address details and, for companies, shareholder/member and share class data, or for LLPs, solvency and record confirmations.
  • Entities relying on the state owned, listed, wholly owned subsidiary, or Jersey regulated parent variations must instead provide the specified substitute information (e.g. parent entity details, senior official details, or confirmation that Commission-held information is correct).
  • Charities relying on the fee exemption must be registered under the Charities (Jersey) Law 2014 to be exempt from the Article 7(1)(b) fee.

Deadlines

  • 6 January 2021: Commencement date of the Financial Services (Disclosure and Provision of Information) (Jersey) Order 2020.
  • 1 June 2026: Effective date of the amendment to Article 5(1) made by the Companies (Jersey) Amendment Law 2026.
