Summary

This document is the official consolidated text of the Banking Business (Depositors Compensation) (Jersey) Regulations 2009, which originally established the Jersey Bank Depositors Compensation Board and a compensation scheme for depositors of banks carrying on banking business in Jersey. The version shown reflects the law as it stood shortly before its repeal: nearly all substantive regulations have been deleted, and the Regulations are shown as spent and no longer operative from 1 July 2026 following the Bank (Recovery and Resolution) (Jersey) Amendment Law 2025.

  • Original scope: Established the Jersey Bank Depositors Compensation Board, the compensation scheme, amounts of compensation payable, levies on banks to fund the scheme, subrogation rights, appeals, and information gathering powers.
  • Repeal mechanism: Almost every operative regulation (interpretation, Board provisions, scheme obligations, compensation amounts, levies, subrogation, appeals, information, final provisions) was deleted by the Bank (Recovery and Resolution) (Jersey) Amendment Law 2025 (L.25/2025).
  • Staged commencement of repeal: Deletions take effect in stages: Article 54(1) and (3) on 13 March 2026, Article 54(2) and (4) on 1 April 2026, and Article 54(5) on 1 July 2026, after which the Regulations are spent and no longer operative.

Because the Regulations are being wound down and are now repealed, this document is presented for historical and legislative-history reference rather than as a source of continuing compliance obligations for banks operating in Jersey.

  • 1 July 2026: Repeal of Article 54(5) takes effect; Regulations become fully spent and no longer operative
