Summary
This is a public statement issued by the Jersey Financial Services Commission warning investors and the public against dealing with Capital Finance (UK) Limited and Capital Finance Limited, which operate the website capita-finance.org. The Commission states these entities are not authorised or registered under Jersey's financial services or banking laws and appear to be carrying on unauthorised business, potentially for fraudulent purposes.
- No registration: Capital Finance has never been registered or applied for registration under the Financial Services (Jersey) Law 1998, so any financial service business it has conducted since 1 July 1999 breaches Article 7 of that Law.
- No banking authorisation: Capital Finance has never been registered or applied for registration under the Banking Business (Jersey) Law 1991, so any deposit taking business it has conducted since 1 October 1991 breaches Article 8 of that Law.
- Fraud warning: Documentation held by the Commission suggests Capital Finance and its website display warning signs of being set up for a fraudulent purpose.
- No affiliation: Neither Capital Finance nor the website are associated with the Capita Fiduciary Group or the wider Capita Group Plc, which are legitimately authorised in Jersey.
The notice asks anyone who has had dealings with Capital Finance to contact the Commission, and reminds readers that all regulated businesses in Jersey are listed on the Commission's website.
