Summary
This is a standard form used by Non-Profit Organisations (NPOs) registered in Jersey to apply for deregistration under Part 6 of the Non-Profit Organizations (Jersey) Law 2008. It collects basic details about the NPO and the reason for deregistering, and requires certification by an authorised person.
- Identification: Name of the NPO and its NPO registration number.
- Reason for deregistration: e.g. liquidation, winding up, or other reason.
- Remaining funds: Whether any funds remain to be disbursed, and if so, where and when they will be distributed.
- Post-deregistration status: If the NPO is not being wound up after deregistration, further details must be provided.
- Certifier details: Name, capacity, signature and date of the person completing and submitting the form.
- Record retention confirmation: Confirmation that relevant records will be retained under Article 10 of the Non-Profit Organizations (Jersey) Law 2008 and, if applicable, Article 4(2) and 5(3) of the Non-Profit Organisations (Prescribed NPOs Additional Obligations) (Jersey) Order 2022.
The form itself does not set a filing deadline; it is submitted whenever an NPO chooses to deregister, and its supporting statements create ongoing record-retention obligations for the NPO.
Key obligations
- The person submitting the form must certify that the information provided is correct to the best of their knowledge.
- The NPO must retain relevant records under Article 10 of the Non-Profit Organizations (Jersey) Law 2008, and where applicable under Article 4(2) and 5(3) of the Non-Profit Organisations (Prescribed NPOs Additional Obligations) (Jersey) Order 2022, even after deregistration.
- If funds remain to be disbursed, the NPO must disclose where and when they will be distributed as part of the deregistration application.
- If the NPO will not be wound up following deregistration, further details must be provided explaining its post-deregistration status.
- The person submitting the form must confirm they are authorised to do so and that the information has been approved by the relevant persons.
