Summary

This is the standard JFSC application form used by a fund (or its trustee, general partner, or company issuing units) to obtain a certificate as an Unclassified Fund under the Collective Investment Funds (Jersey) Law 1988. It collects details on the applicant, the fund's structure, principal and key persons, auditors, and, where relevant, Alternative Investment Fund (AIF) and AIFM information for passporting or exemption purposes.

  • Who must complete it: Applicants seeking certification of a fund as an Unclassified Fund, including companies issuing units, trustees, and general partners.
  • Sections: Section A (application details), B (applicant details, Principal/Key Persons), C (AIF/AIFM details where marketing under AIFMD or UK AIFM Regulations), D (declaration), E and F (fund details, completed once per fund or constituent part).
  • Principal and Key Persons: Must register via the JFSC's myProfile system before the JFSC will process the application.
  • Fees: No fee needs to accompany the form; an invoice is issued with registration documents and must be settled per its terms; fees may still be due even if the application does not proceed to grant.
  • Sanctions and outsourcing: Applicant must confirm sanctions due diligence has been performed and disclose any outsourcing arrangements, submitting a separate Outsourcing Notification if the arrangement is not exempt.
  • Signing: The form must be signed by two Principal Persons of the Applicant.

The form itself does not create new substantive rules but operationalises existing requirements under the Collective Investment Funds (Jersey) Law 1988, the AIF Code, and the myProfile registration regime referenced within it.

Key obligations

  • Applicant must notify the JFSC immediately of any significant changes to the information provided in the application, occurring after submission and before the JFSC's decision.
  • All Principal Persons and Key Persons of the Applicant must complete a myProfile application before the JFSC will process the certificate application.
  • The application must be signed by two Principal Persons of the Applicant.
  • Applicant must confirm that due regard has been, and will be, given to applicable sanctions frameworks, including ongoing consideration after approval is granted.
  • If the Applicant has outsourced or intends to outsource activities and the arrangement is not exempt under section 3.2.2.5 of the Outsourcing Policy Statement, it must complete and submit the JFSC's Outsourcing Notification with the application.
  • Application fees must be settled according to the terms of the invoice issued by the JFSC, even if the application does not proceed to a grant of certificate.
