Summary
This is the standard JFSC application form used by a person or entity seeking registration under Article 9 of the Financial Services (Jersey) Law 1998 to carry on Alternative Investment Fund (AIF) services business. It collects details about the applicant, the AIFs it will service, principal and key persons, and requires a signed declaration before registration can be considered.
- Section A: Details of the application, confirmation of AIF services business status, marketing countries, whether existing COBO funds are involved, and which AIF Code compliance route applies (sub-threshold/small third country, private placement, or full compliance).
- Section B: Applicant details including registered office, accounting information, auditor, business/trading names, membership of self-regulatory bodies, Principal Person and Key Person (MLRO/MLCO) information, and disclosure questions on past refusals, disciplinary action, investigations, seizures, litigation, settlements, convictions, pending proceedings and outsourcing arrangements.
- Section C: Information on the anticipated fund types the applicant will service, including open/closed-ended structure, investment strategy and assets, listing status, umbrella/multi-class/feeder structure, and anticipated volume of activity.
- Section D: Declaration signed by two Principal Persons confirming accuracy of information, awareness of criminal liability under Article 28 for false or misleading information, and ongoing obligations to update the JFSC.
- Fees and submission: The correct fee (per the JFSC's published fee notice) must accompany the form, and completed forms are sent to the JFSC's Central Authorisations department.
- myProfile requirement: Principal Persons and Key Persons applying for the first time, or needing to update information, must complete a myProfile application via the JFSC website before the JFSC processes the application.
The applicant must also notify the JFSC immediately of any significant changes to the information provided between submission and the JFSC's decision on the application. This form is procedural rather than a standalone regulatory requirement, but signing it creates binding representations and disclosure duties under the FS(J)L.
Key obligations
- Applicant must complete Sections A to D of the form in full and pay the correct fee for the application to be valid
- Principal Persons and Key Persons must submit a myProfile application via the JFSC website before the JFSC will process the application
- Applicant must notify the JFSC immediately of any other relevant information or significant changes occurring after submission and before the JFSC's decision
- The application must be signed by two Principal Persons of the applicant, declaring the information is complete and correct
- Applicant must disclose, where applicable, details of any refused/revoked licences, disciplinary actions, investigations, seizures, litigation, settlements of £10,000 or more, convictions, pending proceedings, and outsourcing/delegation arrangements
- Providing false or misleading information in a material particular is a criminal offence under Article 28 of the FS(J)L
