Summary

This is the JFSC's feedback paper following its June 2026 consultation on new fees for trade marks, patents and designs under Jersey's modernised intellectual property framework. It summarises the two responses received, sets out the JFSC's replies to points raised, and confirms that the fees will proceed largely as originally proposed.

  • Fee levels confirmed: The JFSC will implement the fee rates as originally consulted on, with the final Fees Notice attached as Appendix B.
  • Scope of fees: Re-registration fees apply only to UK national patents, EP(UK) patents and UK designs requiring a Jersey application; rights that automatically extend to Jersey (PCT-derived UK/EP(UK) patents and Hague international designs) are not subject to these fees.
  • No search or expedited fees: No fees will be charged for searches or extracts from the public registries, and no expedited processing service (and therefore no associated fee) will be offered.
  • Operational clarifications: Assignments, licences, orders/grants/decisions and certified copies can only be recorded against rights validly registered in Jersey; renewals of Hague-extended designs follow the underlying qualifying right rather than being administered separately by Jersey.

The JFSC concludes that no changes to the proposed fee schedule are needed as a result of feedback, and will proceed to introduce the new fee regime alongside the launch of the new Intellectual Property Registry framework, with further guidance to follow for practitioners.

Key obligations

  • Applicants must pay the prescribed fees set out in the 2026 Fees Notice (Appendix B) for trade mark, patent and design applications, renewals, amendments, oppositions, invalidations, appeals and revocations from 1 August 2026.
  • Applicants seeking to record assignments, licences, or orders/grants/decisions on patents or designs must provide supporting evidence of valid Jersey registration (or underlying UK registration) before such recordal can be made.
  • Requests for certified copies of trade mark, patent or design registrations require payment of the prescribed fee.

Deadlines

  • 1 August 2026: New trade marks, patents and designs fee regime takes effect.
  • 31 December 2027: Period for which the confirmed fees will run before review.
  • annually after 2027: Fees will be reviewed annually as part of the JFSC's ongoing annual fee process and consultation.
