Consultation on proposed fees for trade marks, patents and designs (No. 5 2026)

Summary

This is a JFSC consultation paper seeking industry feedback on proposed fees for trade marks, patents and designs under Jersey's new intellectual property (IP) framework. The fees are designed to align broadly with the UK Intellectual Property Office fee structure while ensuring cost recovery for the new IP registry that JFSC will operate.

• Application fees: Payable when submitting an application for registration of a trade mark, patent or design.
• Renewal fees: Periodic fees required to maintain registered rights.
• Recordal fees: Charged for recording changes such as ownership, licences and security interests.
• Search fees: For registry searches and official extracts.
• Other administrative fees: Cover services such as certified copies of registrations or expedited processing.

The proposed fees will apply to anyone dealing with JFSC under the Registrar of Intellectual Property (Jersey) Law 2026 and the Trade Marks (Jersey) Law 2026, once the new IP registry and legislative framework launches. JFSC has also shared the consultation directly with a range of representative bodies including Jersey Finance, the Jersey Law Society and the Jersey Compliance Officers Association, and invites feedback on fee reasonableness, unintended consequences and implementation issues.

JFSC plans for the fee regime to take effect when the new IP registry launches on 1 August 2026, and intends to review consultation responses before publishing a final fee schedule with sufficient advance notice.
