Capital Markets Advisory (2010-04-08)
Issued 2010-04-08View on JFSC's website Source document
Summary
This is a public warning statement issued by the Jersey Financial Services Commission under Article 25(d) of the Financial Services (Jersey) Law 1998, alerting investors and the public that an entity trading as Capital Markets Advisory (using the websites capitalmarketsadvisory.com and capmarketsadvisory.com) is not authorised to conduct financial service business in Jersey.
- Unauthorised business: Capital Markets Advisory has never registered or applied for registration under the Financial Services Law, so any financial service business it has conducted since 1 July 1999 breaches Article 7 of that Law.
- Fraud warning signs: Documentation held by the Commission suggests Capital Markets Advisory and its websites display warning signs of being set up for a fraudulent purpose.
- No connection to legitimate firm: Capital Markets Advisory is not connected to Capital Markets Advisory, LLC, a separate US SEC-registered firm headquartered in New Jersey.
- False Jersey address: The purported address at 1 Green Street, St Helier, Jersey exists but Capital Markets Advisory has no actual presence there or anywhere else in Jersey.
The notice asks anyone who has had dealings with Capital Markets Advisory to contact the Commission, and reminds the public that all genuinely regulated businesses in Jersey are listed on the Commission's website. It does not impose any ongoing compliance obligation on regulated firms; it is an investor warning about a specific unauthorised and potentially fraudulent entity.
