Summary

This Order amends the Insider Dealing (Securities and Regulated Markets) Order, 1996 by updating and expanding the list of markets that count as regulated markets and regulated exchanges for the purposes of the insider dealing legislation in the Bailiwick of Guernsey. It replaces section 10 (Channel Islands and UK regulated markets) and the Schedule (the wider list of international regulated markets) of the 1996 Order with revised lists.

  • Section 10 replaced: Designates the Channel Islands Stock Exchange, EDX, the London International Futures and Options Exchange, the London Stock Exchange, PLUS, Sharemark and Virt-x as regulated markets for section 15(1)(b) purposes.
  • Schedule replaced: Substitutes a new, expanded list of investment exchanges worldwide (covering stock, futures, options and derivatives exchanges across many jurisdictions) that qualify as regulated markets for section 9 of the Law, plus any exchange that is a member of, or regulated/supervised by a member of, the International Organisation of Securities Commissions.
  • Commencement: The Order came into force on 1 December 2008.

The amendment is purely definitional in nature: it does not create new ongoing filing or reporting obligations but changes which markets are treated as regulated markets under the insider dealing regime, which affects the scope of the insider dealing prohibitions in the 1996 Law.
