The International Criminal Tribunal for the former Yugoslavia (Restrictive Measures) (Overseas Territories) (Revocation) Order 2011 (S.I. 2011/2990)

Summary

This is a UK Order in Council that formally revokes the International Criminal Tribunal for the former Yugoslavia (Restrictive Measures) (Overseas Territories) Order 2004, which had previously required freezing of funds and economic resources belonging to persons indicted by the ICTY for war crimes who remained at large.

The underlying restrictive measures had already expired on 10 October 2011 when the EU Council did not further extend Council Decision 2010/603/CFSP. This Order simply removes the now-defunct 2004 Order from the law of the listed Overseas Territories, including the Cayman Islands and the Virgin Islands, with effect from 18 January 2012.

• Effect: Revokes the ICTY (Restrictive Measures) (Overseas Territories) Order 2004 in its entirety
• Territories covered: Anguilla, British Antarctic Territory, British Indian Ocean Territory, Cayman Islands, Falkland Islands, Montserrat, Pitcairn group, St Helena Ascension and Tristan da Cunha, South Georgia and South Sandwich Islands, Akrotiri and Dhekelia, Turks and Caicos Islands, and the Virgin Islands
• No new measures: Creates no new restrictive measures or obligations; it is purely a repeal of a lapsed sanctions regime

Deadlines

• 18th January 2012: Date on which the revocation Order comes into force
• 10th October 2011: Date on which the restrictive measures under the 2004 Order expired, having not been further extended by the EU Council
