Summary
This is a UK Order in Council that amends the Al-Qa'ida and Taliban (United Nations Measures) (Overseas Territories) Order 2002, the principal sanctions order extending UN Al-Qa'ida/Taliban asset-freezing measures to the Overseas Territories including the British Virgin Islands. It makes technical corrections rather than imposing new substantive duties, chiefly updating the definition of relevant institution and fixing procedural wording elsewhere in the principal Order.
- Definition change: Amends the definition of relevant institution in Article 2(1) so it covers any person who may lawfully accept deposits in or from within the Territory by way of business, removing a prior sub-paragraph and adding guidance on what counts as accepting deposits by way of business.
- Cross-reference update: In Article 1(4), extends a reference from Articles 6, 7 and 8 to also include Article 9.
- Enforcement wording: Article 13(1) is amended to allow an officer authorised for the purpose, as well as the Governor, to exercise certain functions; Articles 15(2) and 16(2) are amended to remove references to authorised officer alongside authorised person.
- Schedule 3 search/seizure wording: Paragraph 2(1) of Schedule 3 is amended to expressly include police officers alongside constables in provisions on search and seizure powers.
The Order itself creates no new filing or reporting duties beyond those already imposed by the principal 2002 Order; it took effect on 14 February 2002. Relevant institutions, i.e. deposit-taking businesses within its updated definition, remain subject to the freezing and related obligations of the principal Order as now amended.
