Investment Business (Registers) Regulations (Revised 2020)

Summary

This regulation sets out the specific information that the BVI Financial Services Commission must record in three statutory registers it maintains under the Securities and Investment Business Act and the Investment Business (Approved Managers) Regulations. It does not impose new duties on licensees beyond what is already required elsewhere, but it defines what data points the Commission's public/administrative registers must contain for each category of registrant.

• Register of Investment Business Licensees: Must contain the licensee's BVI place of business and service address, any overseas place of business, the authorised representative's name and address, licence type/category and grant date, current licence status (including cancellation, suspension or revocation dates), and whether current year fees have been paid and when.
• Register of Certified Authorised Representatives: Must contain the representative's BVI place of business and service address, any overseas place of business, the date certification was granted, current certification status (including cancellation, suspension or revocation dates), and fee payment status/date for the current year.
• Register of Approved Investment Managers (under S.I. 54 of 2012): Must contain the approved manager's BVI place of business and service address, any overseas place of business, the authorised representative's name and address, the date approval was granted, current approval status (including cancellation, suspension or revocation dates), and fee payment status/date for the current year.

In practice this tells regulated entities and their representatives what information the Commission holds and tracks about them, including licence/approval status and fee payment status, rather than creating a new direct filing obligation on the entities themselves.
