Financial Services (Limited Partnership Fees) (Amendment) Regulations, 2021

Summary

This instrument amends the fee schedule attached to the Financial Services (Limited Partnership Fees) Regulations, 2018, which sets fees payable to the Registrar of Limited Partnerships in the British Virgin Islands. It adds new, itemised fees for certificates and documents issued by the Registrar in relation to limited partnerships registered under the Limited Partnership Act, 2017.

• Certified copy or extract: of a certificate of registration, restoration, merger, consolidation, arrangement, continuation, discontinuance, de-registration, good standing, etc. - $75
• Uncertified copy or extract: of the same categories of certificate - $50
• Duplicate certificate: fee of $50
• Physical copy of a certificate: where an electronic version has already been provided - $50
• Other certified or uncertified document: for which no fee is specified elsewhere in the Schedule - $100

The Regulations were made by the Cabinet on 1 April 2021 and gazetted the same day, but they only take effect on a date the Minister later appoints and publishes by Notice in the Gazette, so the new fees are not automatically in force from the gazette date.

Key obligations

• Persons requesting certified or uncertified copies or extracts of limited partnership certificates, duplicate certificates, physical copies, or other unlisted documents from the Registrar must pay the new fees specified in the amended Schedule once the Regulations come into force.

Deadlines

• such date as the Minister may by Notice published in the Gazette appoint: Commencement date of the Regulations (and the new fees) is not fixed in the text itself but depends on a future Ministerial Notice.
