Summary

This is a plain-language FAQ published by the BVI Financial Services Commission explaining the statutory fees charged under the Financial Services (Trade Marks Fees) Regulations, 2015 for trade mark and patent related filings, and for registration and maintenance of Registered Trade Mark Agents. It is informational guidance rather than a binding rule, and does not itself create new legal obligations beyond restating existing statutory fees and form requirements.

  • Trade mark registration: USD 200 for a single class, plus USD 100 for each additional class; defensive trade mark USD 200 for one class plus USD 150 per additional class.
  • Series trade mark registration: USD 250 for the first two marks in the series, plus USD 75 for each additional mark.
  • Patent re-registration: USD 100 fee to re-register a patent in the BVI.
  • Patent annual renewal: USD 50 per year.
  • Trade Mark Agent application: USD 350 application fee to become a Registered Trade Mark Agent.
  • Trade Mark Agent annual renewal: USD 250 per year, payable as long as the agent holds a Licence.
  • Agent registration cancellation: No fee, but form TM23 must be submitted.
  • Agent address change: Form TM19 plus USD 100 per trade mark to update the agent's address and address for service.
  • Change of agent: Form TM19 plus USD 150 per trade mark to change the agent's name, address, and address for service.
  • Agent business name change: No re-approval needed if it is the same person, but a USD 50 fee per trade mark applies to update the Register.

Key obligations
