Summary

This is a standard form issued by the BVI Financial Services Commission's Registrar of Trade Marks, Patents and Copyright. It allows the proprietor of a registered trade mark to apply to change (reclassify) the classification of that trade mark under the Trade Marks (Filing) Guidelines, 2018 and the Trade Marks Rules, 2015.

  • Purpose: Requests the Registrar to exercise discretion under rule 45(a) of the Trade Marks Rules, 2015 to reclassify a registered trade mark's class.
  • Required details: Proprietor's name, trade mark registration number, current class(es), proposed class(es), any supporting documents, registered agent details and trade mark agent number, and date of application.
  • Effect: Filing this form does not guarantee reclassification; the Registrar retains full discretion and will issue a separate Notice of Proposed Change to Reclassification under rule 45(a) after considering the application.

The form itself does not create ongoing compliance obligations beyond accurately completing and submitting the application; it is a procedural filing mechanism rather than a substantive regulatory requirement.

Applies to

proprietors of registered trade marks, registered trade mark agents
