Summary
This is an advisory notice from the BVI Financial Services Commission informing the public that The South Sudan (Sanctions) (Overseas Territories) Order 2014 was ratified on 5 November 2014 and extended to the British Virgin Islands. The Order gives effect locally to European Union sanctions against South Sudan adopted under Council Decision 2014/449/CFSP.
- Arms embargo: Prohibits the supply of arms and related assistance to South Sudan.
- Asset freeze and travel ban: Applies to persons designated by the EU Council as obstructing the political process in South Sudan, committing violence or ceasefire violations, or responsible for serious human rights violations, and persons associated with them.
- Licensing exemptions: The Order allows the Governor to license certain otherwise-prohibited activities in line with exemptions under the sanctions regime.
The notice directs readers to the full text of the EU Council Decision and the UK Statutory Instrument, and to the UK consolidated list of financial sanctions targets, which updates automatically as new sanctions orders are extended to the Overseas Territories.
Key obligations
- Persons and businesses in the British Virgin Islands must comply with the asset freeze and must not make funds or economic resources available to persons designated under the South Sudan sanctions regime.
- Persons and businesses must comply with the arms embargo and must not provide related assistance to South Sudan.
- Any party wishing to undertake activity otherwise prohibited by the sanctions must obtain a licence from the Governor under the exemptions provided in the Order.
