Summary

This is an advisory from the BVI Financial Services Commission notifying the general public and regulated persons of The Afghanistan (United Nations Measures) (Overseas Territories) Order 2012, which implements United Nations Security Council sanctions against the Taliban and associated persons threatening the peace and security of Afghanistan.

  • Legal basis: Gives effect to UN Security Council Resolution 1988 (2011), which maintains sanctions originally imposed by Resolution 1267 (1999) against the Taliban, now separated from the Al-Qaida sanctions regime under the parallel Resolution 1989 (2011).
  • Asset freeze: Continues the freeze on assets of the Taliban and persons designated by the Security Council as constituting a threat to Afghanistan's peace and security, and prohibits making funds available to such persons.
  • Arms embargo: Prohibits the supply of military goods and technical assistance related to military activities to designated persons.
  • Designated persons list: Directs readers to the UN Security Council's 1267 Committee consolidated list of designated persons for compliance purposes.

The advisory itself does not impose new obligations beyond directing compliance with the 2012 Order, which is UK/OT legislation extended to the BVI; it links to the full Order and related UN resolutions for reference.
