Summary

This is an FSC advisory notifying the public and all regulated persons in the British Virgin Islands that the Afghanistan (United Nations Sanctions) (Overseas Territories) Order 2001 has been amended by the Afghanistan (United Nations Measures) (Overseas Territories) (Amendment) Notice 2011. The amendment gives effect to UN Security Council Resolution 1988 (2011) and updates the list of individuals and entities in Afghanistan subject to an assets freeze, travel ban and arms embargo.

  • Legal effect: It is an offence to make funds available, without a licence from the Governor, to or for the benefit of the Taliban, Al Qaida, Usama Bin Laden, or any person or entity on the UN Consolidated List, or anyone acting on their behalf.
  • New listings: Three new individuals associated with the Taliban were added to the UN Committee's sanctions list on 4 October 2011: Haji Faizullah Noorzai Akhtar Mohammed Mira Khan, Haji Malik Noorzai, and Abdul Aziz Abbasin.
  • Ongoing list monitoring: The Committee's List is updated regularly and an updated version, along with narrative summaries of listing reasons, is accessible on the UN Committee's website.

The notice does not impose new filing or reporting deadlines beyond the existing legal requirement to comply with the sanctions regime; it serves to alert regulated entities and the public to the updated list and their continuing obligation not to deal with listed persons without a licence.

Key obligations

  • Regulated and other persons must not make funds available to, or for the benefit of, the Taliban, Al Qaida, Usama Bin Laden, or any individual or entity on the UN Consolidated List (including the three newly added Taliban-associated individuals), except under a licence granted by the Governor.
  • Regulated persons should screen clients and transactions against the updated UN Consolidated List to ensure compliance with the assets freeze, travel ban and arms embargo.
