Issued 2026-06-30View on BMA's website Source document
Summary
This is a public enforcement notice from the Bermuda Monetary Authority announcing that it petitioned the Supreme Court of Bermuda to wind up Yew Tree Investments Limited, an authorised investment fund, under the Investment Funds Act 2006 and the Companies Act 1981. The Court ordered the winding up on 5 June 2026 and appointed Joint Provisional Liquidators from Teneo (Bermuda) Limited to take control of the Company.
- Grounds for winding up: The Authority cited repeated failures by the fund to prepare audited financial statements, to carry out Net Asset Valuations and notify the Authority or seek a waiver, to appoint an administrator, and to file statements on compliance with the IFA, concluding the fund could not conduct business prudently or restore compliance.
- Outcome: The Company was wound up by Court order and Charles Thresh and Michael Morrison of Teneo (Bermuda) Limited were appointed as Joint Provisional Liquidators.
- Contact: Questions regarding the Company should be directed to the JPLs via the named contact email.
This notice is informational and specific to Yew Tree Investments Limited; it does not itself create new ongoing regulatory obligations for other licensees, though it illustrates the BMA's enforcement approach to breaches of audit, valuation, administrator-appointment and compliance-reporting requirements under the Investment Funds Act 2006 and Investment Fund Rules 2019.
