Summary

This notice announces that the Bermuda Monetary Authority (BMA) has published a Consultation Paper proposing amendments to the investment fund regulatory framework. The proposals would introduce sustainability disclosure requirements and prohibit misleading fund names for Bermuda-registered and authorised funds. This is a consultation only; no rules have yet been finalised.

  • Sustainability disclosures: Funds that claim to be 'sustainable' or to pursue sustainable investment strategies would be required to provide additional disclosures, including material sustainability risk disclosures, in fund offering documents.
  • Misleading names prohibition: Bermuda-registered and authorised funds would be prohibited from using misleading names, formalising existing BMA supervisory practice.
  • Consultation process: Stakeholders are invited to submit feedback on the Consultation Paper to policy@bma.bm.

No obligations are currently in force; the notice is soliciting industry comment before any rule changes are adopted.
